First establish which Smith County issued the case

“Smith County criminal records” does not identify one state. Smith County, Texas and Smith County, Tennessee have separate courts and custodians; these are useful examples, not a complete list of every Smith County. For Texas, keep the County Clerk and District Clerk routes distinct

Smith County, Texas has a County Clerk Criminal Misdemeanor department that records all misdemeanors and some felony offenses. The District Clerk keeps felony case records and is the office of record for District Court proceedings. Use the court and cause number to choose the custodian rather than assuming the word “criminal” always means one office.

The District Clerk links the Smith County Public Search Site for jail and court records. Choose the criminal court-case material for a prosecution. County Clerk Official Public Records is a separate recorded-document collection, covering such matters as assumed names and property documents. A miss there is not a search of all criminal cases, and a jail result is not a final judgment.

Request the Texas document and quote the correct fee category

The Texas District Clerk is at 100 North Broadway, Room 204, Tyler, TX 75702; telephone 903-590-1660. Its page lists regular emailed copies at $1 per page for 0–15 pages and $15 per document for 16 pages or more. Paper copies or certified copies are listed at $1 per page. Confirm the exact document, certification and fulfillment before paying.

The office is open Monday–Friday, 8 a.m.–5 p.m., but stops accepting payments at 4:30 p.m. Keep the receipt: overpayments under $10 require a written refund request within 30 days with the receipt; refunds of $10 or more are processed automatically. Its page does not promise one copy-delivery timeframe.

For a County Clerk criminal file, use the Criminal Misdemeanor page and its Frequently Asked Criminal Questions link to contact the appropriate department. Identify the county-court cause number and requested order. Do not apply the District Clerk’s emailed-copy schedule to the County Clerk without confirmation; the reviewed criminal-department page does not publish its copy total or turnaround.

For Tennessee, contact its Circuit Court Clerk

Smith County, Tennessee’s Circuit Court Clerk oversees court records and dates and distinguishes General Sessions from Circuit Court matters. The office lists 322 Justice Drive, Suite 115, Carthage, TN 37030; telephone 615-735-0500; and Monday–Friday hours of 8 a.m.–4 p.m. Use that office’s own instructions rather than the Texas department labels.

Give the clerk the name, case or citation number, approximate date and division, and ask for the specific public order or certified copy. The page links fine payment, which is not a document-order or comprehensive criminal-search service. It does not publish a general copy fee or delivery guarantee. Confirm those points directly before mailing payment or making a trip.

Read the disposition and address a mismatch at its source

Once you find a possible case, retain the state, court, complete number and event dates. Ask the hearing clerk for the final judgment or dismissal if the online summary is insufficient. Compare identifiers before attributing the record to someone. An arrest or a pending charge is not proof of conviction, and a missing online hit is not proof that no file exists.

For a Texas statewide history question, DPS provides a separate Criminal History Conviction Name Search; it does not replace either county clerk’s file. When correcting a missing Texas repository disposition, DPS requires a certified disposition from the court of jurisdiction for its Error Resolution Unit. Use that Texas procedure only for Texas records.

For a disputed court entry in either supported county, contact the actual holding clerk with the case reference and the document that appears inconsistent. Ask whether access limits, a later order or a different division explain the result. If the record belongs to another Smith County entirely, stop using these examples and identify that jurisdiction’s own court-record custodian.
